Terms of service

1. Who we are
bluemarbleparis.com is operated by APA Capital SAS, trading as Bluemarble, 51 rue Lepic, 75018 Paris, France, registered in Paris under number 825 302 227, VAT FR26 825 302 227. In these terms, "we" and "Bluemarble" mean APA Capital SAS. You can reach us at shop@bluemarbleparis.com or on +33 1 82 83 38 48.
2. These terms
These terms apply to every order placed on this site. By placing an order you accept them. The version that applies is the one published on the site on the day you order. We may update these terms; changes apply only to orders placed after they are published. Nothing in these terms reduces the rights you have as a consumer under the law of the country where you live.
3. Our pieces
Our collections are produced in small quantities and a size can sell out while you are ordering. If a piece you have ordered turns out to be unavailable, we will tell you and refund you in full. Photographs are as faithful as we can make them; colours depend on your screen. Hand-embroidered and hand-finished pieces vary slightly from one to the next.
4. Prices
Prices are shown in the currency selected for your country. For deliveries within the European Union and the United Kingdom they include VAT. For deliveries elsewhere, prices do not include import duties or local taxes, which are explained in our shipping policy and, where applicable, shown at checkout. Shipping costs are shown at checkout before you confirm your order. We may change our prices at any time; the price you pay is the one shown when you confirm your order. If a price on the site is obviously wrong, we may cancel the order and refund you.
5. Ordering
To order, add a piece to your bag, enter your delivery and payment details, check your order and confirm it. We send an email confirming your order; the sale is concluded when that email is sent. We may decline an order, for example if payment fails, if an address cannot be verified, or if an order appears to be for resale. If we decline an order after payment, we refund it in full.
6. Payment
We accept Visa, Mastercard, American Express and Cartes Bancaires, as well as Apple Pay, Shop Pay and PayPal. Instalment options, where offered, are shown at checkout and are subject to the provider's own terms. For payments in full, payment is taken when you place your order. For instalment payments, charges follow the payment schedule agreed with the provider. Payments are processed by our payment providers over an encrypted connection; we do not store your card number.
To make your purchase more flexible, we offer eligible customers the option to pay in instalments with Oney, subject to Oney’s approval. The following terms apply when you choose this payment method:
By accepting these terms, the customer accepts:
7. Delivery
We ship worldwide from Paris. Carriers, costs and estimated delivery times are set out in our shipping policy. Delivery times are estimates. If your order has not arrived within 30 days of the delivery date we gave you, you may cancel it and we will refund you in full. You become responsible for the piece when it is delivered to you or to someone you have named to receive it. Please check your parcel on delivery and tell us promptly if it arrives damaged.
8. Right of withdrawal
If you are a consumer, you may withdraw from your order for any reason within 14 days of the day you receive it. To do so, email shop@bluemarbleparis.com with your order number. You then have 14 days to send the piece back to us, unworn, unwashed and with its labels attached. We refund the price using the original payment method within 14 days of receiving the piece or proof that you have sent it. Return shipping is explained in our returns policy. Pieces made to your specification or personalised for you cannot be returned under this right.
9. Legal guarantees
Everything we sell is covered by the legal guarantee of conformity (Code de la consommation, articles L217-3 to L217-20) for two years from delivery, and by the guarantee against hidden defects (Code civil, articles 1641 to 1649). If a piece is not as described or has a fault, you may ask for it to be repaired or replaced or, if that is not possible, for a price reduction or a full refund, and we bear the cost of returning it. These guarantees apply independently of our returns policy and of your right of withdrawal.
10. Returns and exchanges
Our returns policy explains how to return or exchange a piece, what condition it needs to be in and how refunds work.
11. Intellectual property
The Bluemarble name, our designs, photographs, films and the text on this site belong to APA Capital SAS or to the people who created them for us. You may not copy or reuse them without our written permission.
12. Personal data
How we collect and use your personal data is set out in our privacy policy.
13. Our responsibility
We are responsible for delivering what you ordered as described, and for the legal guarantees above. We are not responsible for events outside our reasonable control, such as a carrier strike or a customs delay, although we will do what we can to help, nor for websites we link to that we do not operate. Nothing in these terms limits our responsibility where the law does not allow it to be limited.
14. Disputes
If something has gone wrong, write to us first at shop@bluemarbleparis.com; most problems are solved that way. These terms are governed by French law. Consumers living elsewhere in the European Union keep the protection of the mandatory rules of their own country. Any dispute that cannot be settled otherwise goes to the competent French courts.
